Luigi Mangione requests state murder charges be dropped, evidence suppressed

Luigi Mangione’s lawyers filed a motion to the New York Supreme Court seeking to have evidence suppressed and have his state charges for the assassination of UnitedHealthcare CEO Brian Thompson dismissed.

Mangione faces 11 charges in New York court over his alleged killing of Thompson on Dec. 4, 2024, outside the Hilton hotel in Midtown Manhattan. He has pleaded not guilty to state and federal charges against him. In the filing Thursday, Mangione’s lawyers argue that charging him for the alleged murder in both state court and federal court amounted to double jeopardy, according to the Associated Press.

The lawyers have said if the case cannot be tossed in state court, they want the terrorism charges dismissed and want various pieces of evidence collected when Mangione was arrested last year in Altoona, Pennsylvania, and statements he made to police during the attest, thrown out.

“Yet, despite the gravest of consequences for Mr. Mangione, law enforcement has methodically and purposefully trampled his constitutional rights,” his lawyers wrote in the court filing.

The Manhattan district attorney’s office has said it will respond to the filing with its own filings to the court.

A trial date has not been set for Mangione’s state court trial, but he is expected back in court for that case on June 26. The maximum punishment for the state charges is life in prison.

Mangione also faces federal charges, where prosecutors have said they will seek the death penalty.

A trial date has not been set for the federal case against Mangione, but he is expected back in court for that case on Dec. 5.
